3. Description of the legal requirements
a.) Scope and content of the legal requirements
The accessibility requirements are derived from the Accessibility Enhancement Act (Barrierefreiheitsstärkungsgesetz (BFSG), available at https://www.gesetze-im-internet.de/bfsg/, German language only) as well as the regulation implementing the BFSG (Verordnung zum Barrierefreiheitsstärkungsgesetz (BFSGV), available at https://www.bmas.de/SharedDocs/Downloads/DE/Gesetze/verordnung-zum-barrierefreiheitsstaerkungsgesetz.pdf?__blob=publicationFile&v=3, German language only), which together implement the requirement of the EU Directive on Accessibility (EEA. Directive (EU) 2019/882 of the European Parliament and of the Council of 17 April 2019 on the accessibility requirements for products and services and its implementations into national law in Europe, available at https://eur-lex.europa.eu/legal-content/EN/TXT/PDF/?uri=CELEX:32019L0882).
The purpose of this legislation is to harmonize accessibility requirements for the EU market, ensure the accessibility of products and services in the interests of consumers and users with disabilities and thereby improve participation in society.
The German legislation applies, amongst others, to so-called “e-commerce services” (Section 1 (3) No. 5 BFSG), which covers websites, online shops, and apps which contain the option to enter online into an agreement with a provider.
In this context, the German legislation further refers to harmonized (technical) standards or parts thereof which have been published in the Official Journal of the European Union, which includes the harmonized European standard EN 301 549 (available at: https://www.etsi.org/deliver/etsi_en/301500_301599/301549/03.02.01_60/en_301549v030201p.pdf) concerning accessibility requirements for ICT products and services. The latter refers to the WCAG 2.1 Level AA success criteria (available at: https://www.w3.org/TR/WCAG21/) as a threshold for accessibility.
Frisbii has taken all necessary measures in accordance with the applicable harmonized EU standards within its products and services to enable Frisbii’s B2B customers to fulfill their legal obligations in this respect when implementing Frisbii’s products and services and integrating them into their e-commerce-services.

- Comprehensibility
Content should be easy to read and use.
- Examples: Use simple language, consistent navigation, and clear error messages on forms.
